Compass Platform Terms -- Families
Terms of service, consent requirements, and data rights for parents, guardians, and students using the KOTY Compass educational technology platform.
Compass Platform Terms -- Families
These terms apply to parents, guardians, and students who use the KOTY Compass platform through a Kids on the Yard subscription. These terms supplement the Compass Platform Terms of Service and the Kids on the Yard Privacy Statement.
Consent Requirements
Parental Consent (Children Under 13)
Under the Children's Online Privacy Protection Act (COPPA), Kids on the Yard requires verifiable parental consent before the Compass platform collects, uses, or processes personal information from any child under the age of 13. This includes:
- Student profile information (name, age, grade level)
- Session recordings and transcripts (where session recording is enabled)
- Progress data, assessment results, and educator notes
- AI-generated summaries, reports, and recommendations
- Communication between the student and educators through the platform
Parental consent for Compass is obtained through the enrollment process. A parent or legal guardian must explicitly opt in to Compass features during enrollment or at any time after enrollment through the care team.
For full details on COPPA consent, see COPPA Consent.
Parental Consent (Children 13 and Older)
For students aged 13 and older, parental consent is still required for Compass enrollment when the student is under the age of majority in their state (typically 18; see Age Requirements for state-specific ages). Students at or above the age of majority may consent independently.
What You Are Consenting To
By opting in to Compass, you consent to:
- Data collection: Kids on the Yard collects the student's educational data as described in the Privacy Statement, including session activity, progress metrics, and educator observations.
- AI processing: The student's educational data is processed by artificial intelligence to generate session summaries, progress reports, goal tracking, and recommendations. See AI Processing Disclosure for details.
- Data storage: Educational records are stored in the United States in accordance with the Data Retention Policy.
- Educator access: The student's assigned educators, the care team, and authorized Kids on the Yard staff can view the student's Compass data to provide and improve services.
Right to Opt Out
Compass is optional. You may use Kids on the Yard services without Compass. If you opt out of Compass:
- Sessions continue as normal (scheduling, delivery, cancellation policies unchanged)
- AI-generated summaries and progress reports will not be produced
- Manual progress notes from educators (if any) remain available
- You will not have access to Compass analytics, goal tracking, or digital document vault features
- No penalty or fee applies for opting out
- You may opt back in at any time by contacting the care team
To opt out, contact the care team via the approved channels (care team email, office phone, or form link). Opt-out requests are processed within 2 business days.
Your Data Rights
Access
You have the right to access all of your child's educational data stored in Compass, including:
- Session logs and attendance records
- AI-generated summaries and progress reports
- Educator notes and observations
- Assessment documentation
- Any data shared with third parties (schools, districts)
To request access, contact [email protected]. Requests are fulfilled within 30 days.
Correction
If you believe any data in Compass is inaccurate, you may request correction by contacting [email protected]. Corrections are processed within 30 days. If a correction is denied, you will receive a written explanation and may file a statement of disagreement that will be attached to the record.
Deletion
You may request deletion of your child's Compass data at any time by contacting [email protected]. Upon receiving a verified deletion request:
- All Compass-specific data (AI summaries, progress reports, analytics) is deleted within 30 days
- Session attendance records may be retained as required by law or contract (see Data Retention Policy)
- Deletion of Compass data does not cancel the underlying subscription -- cancel separately if desired
- Deletion is permanent and cannot be undone
Data Portability
You may request a copy of your child's Compass data in a common machine-readable format (JSON or CSV) at any time. Portability requests are fulfilled within 30 days. This includes all data listed in the Access section above.
Sharing Controls
Compass data is not shared with any third party (including schools, districts, or other service providers) without your explicit written consent. If you authorize sharing with a school or district:
- You choose which records to share
- Sharing can be revoked at any time
- The school or district's own privacy policy governs their use of the shared records after receipt
- Kids on the Yard is not responsible for how a school or district uses records after they are shared at your request
Session Recording Consent
If session recording is enabled for your child's services, Compass may use those recordings to generate AI-powered session summaries. Session recording consent is governed by the Recording Consent and State Law section of the Privacy Statement. You may disable session recording without disabling Compass -- in that case, AI summaries are generated from educator notes and activity logs only.
Security
Compass data is protected by the same security measures that apply to all Kids on the Yard services:
- Encryption in transit (TLS 1.2+) and at rest (AES-256)
- Role-based access controls (only assigned educators and authorized staff)
- Audit logging of all data access
- Regular security assessments
- Incident response procedures as described in the Incident Response Policy
Billing
Compass features may be included in your base subscription or available as add-on services. Add-on features are billed separately and require explicit opt-in. See Add-On Services for billing terms. Opting out of Compass does not reduce your base subscription rate unless Compass was enrolled as a separate add-on.
Changes to These Terms
Kids on the Yard may update these Compass Family Terms from time to time. If a material change is made, you will receive at least 30 days advance notice via email before the change takes effect. Continued use of Compass after the change takes effect constitutes acceptance of the updated terms. If you do not agree with a material change, you may opt out of Compass without penalty.
