Refund and Cancellation Policy
Effective Date: March 19, 2026
Policy Summary
IMPORTANT: ALL PURCHASES ARE FINAL. KIDS ON THE YARD OPERATES A STRICT NO-REFUND POLICY.
All session hours, packages, and services must be used within the specified timeframe or they will be forfeited. We do not issue refunds for unused hours, cancelled sessions, or any other reason except where required by applicable law.
Subscribers: The "all purchases are final" rule above does NOT override a Subscriber's right to end future billing through the 30-day subscription cancellation notice process described in the Subscription Cancellation section below. The Subscriber remains responsible for all billing cycles that fall within the 30-day notice window. See Paused or Modified Subscriptions for how modifications interact with cancellation.
No Refund Policy
All Sales Are Final
By purchasing any Kids on the Yard service, you acknowledge and agree that:
- All purchases are non-refundable
- Unused hours are non-refundable
- Prepaid packages are non-refundable
- Session credits are non-refundable
- Registration and enrollment fees are non-refundable
- Assessment and material fees are non-refundable
This policy applies to all services including online tutoring, in-person tutoring, coaching, SPED services, paraprofessional services, ABA therapy, and all other educational services.
Legal Exceptions Only
Refunds will only be issued where required by applicable law. If you believe you are entitled to a refund under applicable consumer protection laws, submit a written request with legal basis to [email protected].
Session Usage Requirements
Use-It-Or-Lose-It Policy
All purchased session hours must be used within the specified validity period:

After the validity period expires, all unused hours are automatically forfeited with no refund, credit, or compensation.
No Rollovers
- Unused hours do NOT roll over to the next period
- Unused hours do NOT convert to credits
- Unused hours do NOT transfer to other accounts
- Unused hours have NO cash value
Your Responsibility
It is your sole responsibility to:
- Schedule and use your sessions within the validity period
- Monitor your remaining hours and expiration dates
- Book sessions in advance to ensure availability
- Complete all sessions before expiration
We are not responsible for reminding you of expiring hours or for your failure to use purchased sessions.
Understanding Cancellation Types
Two types of cancellation exist and should not be confused:
- Session cancellation (minimum 24 hours notice, may vary by service type): cancels a single scheduled session. Your subscription continues. Requests received outside business hours are processed on the next business day -- plan accordingly for weekend and holiday sessions.
- Subscription cancellation (30 days written notice): ends your recurring service entirely. See the Subscription Cancellation section below.
Session Cancellation Policy
24-Hour Session Cancellation Requirement
All sessions (online and in-person) require a minimum of 24 hours advance notice for cancellation.

Weekend and Holiday Session Cancellations
Session cancellation requests received outside of business hours (evenings, weekends, or holidays) are timestamped at the time of submission but processed on the next business day. The 24-hour notice window is calculated from the scheduled session time, not from when the request is processed.
Weekend cutoff: If a session is scheduled for Saturday or Sunday, the cancellation request must be submitted by Friday before 5:00 PM Eastern Time. Cancellation requests submitted after this cutoff for weekend sessions may not be processed in time and may be treated as late cancellations at the care team's discretion.
If a session is scheduled for Monday and the cancellation request is submitted on Saturday, the 24-hour requirement is met (submitted 48+ hours before session).
Late Cancellations Are Charged
If you cancel with less than 24 hours notice or fail to attend a scheduled session:
- The session WILL BE DEDUCTED from your package
- You will NOT receive a credit
- You will NOT be able to reschedule
- The session is considered USED AND COMPLETED
No Exceptions
This policy applies to all cancellations regardless of reason, including but not limited to:
- Illness or medical issues
- Family emergencies
- Work conflicts
- Travel
- Forgetting the appointment
- Technical issues on your end
- Weather (for online sessions)
Repeated Cancellations
Clients who repeatedly cancel with less than 24 hours notice may:
- Be required to prepay for sessions
- Have scheduling privileges restricted
- Be terminated from services
Future Cancellation Notice Adjustments
Kids on the Yard reserves the right to adjust the minimum session cancellation notice period by service type (for example, 24 hours for online sessions, 48 hours for in-person sessions requiring educator travel) and to introduce automated cancellation fees processed at the time of late cancellation or no-show. If such changes are introduced, Subscribers will receive at least 30 days written notice before the new terms take effect. Until automated enforcement is implemented, session cancellation policies are enforced manually by the care team during business hours.
Rescheduling Policy
With 24+ Hours Notice
If you provide at least 24 hours notice:
- Session is returned to your available pool
- You may reschedule for any available time
- Session must still be used within your validity period
- No extensions to validity period are granted for rescheduling
Educator Cancellations
If Kids on the Yard or our staff cancels a session:
- Session is returned to your pool
- Priority rescheduling offered
- Session validity period is NOT extended
Service-Specific Terms
Online Services
- All online session cancellation policies apply as stated above
- Technical issues on your end (internet, device, software) do NOT excuse the 24-hour requirement
- You are responsible for having working equipment and internet
In-Person Services
- All in-person session cancellation policies apply as stated above
- Travel time and preparation by our staff is not refundable
- Location changes require 24 hours notice
School/Institutional Contracts
- Governed by individual contract terms
- Minimum commitment periods apply as specified in contract
- Early termination fees apply as specified in contract
- Unused contracted hours are forfeited at contract end
- No refunds unless specified in contract
SPED and ABA Services
- All policies above apply
- Cancellations affect continuity of care
- Repeated cancellations may result in service termination
- Insurance billing (if applicable) is separate from this policy
Package and Subscription Terms
Prepaid Packages
- Full payment required at purchase
- Hours must be used within validity period
- No partial refunds for unused hours
- No extensions to validity period
- Packages are non-transferable
Subscriptions
- Billed in advance for each period
- Access continues until end of paid period
- Unused hours forfeit at period end
Minimum Subscription Terms
Online services have no minimum commitment period beyond the 30-day cancellation notice requirement. In-person services, in-center placements, and school contracts are subject to minimum commitment periods as specified in the applicable service-specific Terms of Service. The 30-day cancellation notice applies in addition to any minimum commitment -- a Subscriber under a 3-month minimum commitment who cancels in month 1 remains responsible for the full minimum term, not just 30 days.
New Subscriber Cooling-Off Period
New subscribers within their first 14 days of service may cancel with immediate effect under the new-subscriber terms in the applicable service-specific Terms of Service. The 30-day notice requirement does not apply during this initial 14-day period. This cooling-off period begins on the date of the first scheduled session, not the date of enrollment.
30-Day Subscription Cancellation Notice
All subscription cancellations require 30 days written notice submitted via the approved channels in the applicable Terms of Service (care team email, office phone, or form link issued by the care team). The 30-day notice is operational, not administrative -- it exists because Kids on the Yard reserves an educator's calendar for the Subscriber during this period and cannot immediately reassign the slot.
Cancellation requests submitted by phone to the office are logged by the care team and treated as written notice effective from the date and time of the call. The care team will send a written confirmation to the Subscriber's email on file.
Kids on the Yard will acknowledge receipt of a cancellation request within 2 business days. If you do not receive acknowledgment, contact the office by phone at +1 786-382-2000. The cancellation date is the date the request was sent (not acknowledged), provided it was sent via an approved channel.
What the Subscriber owes during the 30-day notice period:
- The Subscriber remains responsible for all scheduled billing cycles that fall within the 30-day notice window.
- The subscription terminates at the end of the 30-day notice period. No billing cycle that begins after the notice period expires will be processed.
- Sessions remain available to the Subscriber during the 30-day notice period. Sessions not used during the notice period are forfeited -- they are not credited, refunded, or carried forward.
Payment failure during the notice period:
If a scheduled payment fails during the 30-day notice period, the cancellation proceeds on schedule. The outstanding balance remains due as an account receivable. Service may be suspended pending payment, but the cancellation date does not extend.
Paused or Modified Subscriptions and the 30-Day Notice
Modifications (reductions, downgrades, pauses) and cancellations are separate events. A modification does not constitute a cancellation request, and a cancellation request does not require a prior modification.
- A pause suspends session delivery but does not eliminate the 30-day cancellation billing obligation. If a Subscriber cancels during a pause, billing for the 30-day notice period resumes at the rate in effect when the pause began. The educator's calendar slot remains reserved during a pause, which is why the billing obligation continues.
- If a Subscriber reduces service hours and cancels in a later billing cycle, the 30-day notice billing is calculated at the reduced rate (the current plan rate at the time of cancellation).
- If a Subscriber reduces service hours and cancels within the same billing cycle, the 30-day notice billing is calculated at the rate in effect immediately before the reduction. A reduction followed by a cancellation within the same billing cycle is treated as a single cancellation event.
- A modification does not reset, restart, extend, or shift the 30-day cancellation notice window. The notice runs from the date Kids on the Yard receives the written cancellation request, regardless of any prior or concurrent modification.
Calendar Slot Reservation During a Pause
When a subscription is paused, Kids on the Yard holds the Subscriber's assigned educator and time slot for a maximum of 14 days from the start of the pause at no additional charge. After 14 days, the slot is released to accommodate other families. The Subscriber will be notified before any slot release and may select a new educator or time slot (or the same slot if still available) upon return.
Seasonal pauses (summer break, extended school holidays) follow the same 14-day slot reservation rule. Families who wish to guarantee their educator and time slot for the following term should contact the care team about a slot reservation arrangement.
Kids on the Yard reserves the right to introduce a calendar slot reservation fee for paused subscriptions in the future. If such a fee is introduced, Subscribers with active pauses will receive at least 30 days written notice before the fee takes effect. Subscribers who do not wish to pay the reservation fee may release the slot -- in that case, the Subscriber selects a new educator or time slot (or the same slot if still available) upon return.
Educator Unavailability and Cancellation Rights
If a Subscriber's assigned educator is no longer available due to Kids on the Yard's internal staffing changes (termination, resignation, or reassignment), the Subscriber may cancel with immediate effect and no 30-day notice billing obligation, or accept a replacement educator. This exception does not apply when the Subscriber requests a different educator.
Price Adjustments
Kids on the Yard reserves the right to adjust pricing for any service at any time due to market conditions, cost changes, or service improvements. By enrolling in any Kids on the Yard service, the Subscriber acknowledges and agrees that pricing is subject to change and that the current rate schedule is published on the Kids on the Yard website and reflected on each invoice.
- Price adjustments take effect on the next billing cycle start date or 14 days after the adjusted price is published, whichever comes first.
- The adjusted price will appear on the Subscriber's next invoice or billing notification. The invoice or billing notification constitutes notice of the price change. No separate written notice is required.
- If the Subscriber does not cancel before the adjusted rate is charged, the Subscriber is deemed to have accepted the new rate. The Subscriber may cancel at any time per the 30-Day Subscription Cancellation Notice section if they do not agree with the adjusted pricing.
- Price decreases may take effect immediately at Kids on the Yard's discretion.
- Pricing for prepaid packages is locked at the time of purchase for the duration of the package validity period.
Add-On Services
Kids on the Yard offers and may introduce additional services available as add-ons to any active subscription. Add-on services are billed separately from the base subscription and may have their own pricing, terms, and cancellation rules. Current and upcoming add-on services include but are not limited to:
Record Keeping and Documentation
- Official SPED assessment documentation and record management
- IEP (Individualized Education Program) progress tracking and reporting
- Session notes and progress reports archive
- Compliance documentation for school districts and state agencies
SPED and Therapeutic Services
- Formal assessments and evaluations (behavioral, educational, developmental)
- Assessment report preparation and delivery
- IEP meeting preparation and attendance support
- Transition planning documentation
Homeschooling Support
- Curriculum planning and record keeping
- Attendance and progress documentation for state compliance
- Portfolio assembly for state reviews
- Transcript preparation
Compass Platform Features
- AI-powered progress monitoring and analytics
- Automated session summaries and parent reports
- Goal tracking aligned to IEP objectives
- Multi-provider coordination dashboard
- Digital document vault for educational records
Add-On Billing Terms
- Add-on services are optional and require explicit enrollment
- Add-on fees appear as separate line items on invoices
- Cancellation of the base subscription automatically cancels all associated add-ons unless the add-on has its own minimum commitment
- Add-on services with no minimum commitment may be cancelled independently with the same notice period as the base subscription (30 days for recurring add-ons, immediate for one-time services)
- Kids on the Yard reserves the right to introduce new add-on services. New add-ons will never be auto-enrolled -- Subscribers must opt in explicitly
- Pricing for add-on services will be published on the applicable service page or provided by the care team before enrollment
Account Termination
Voluntary Termination
If you choose to terminate your account:
- All unused hours are immediately forfeited
- No refunds issued for any reason
- Outstanding balances remain due
- Access ends immediately upon termination
Termination by Kids on the Yard
We reserve the right to terminate services for:
- Violation of terms of service
- Non-payment
- Abuse of staff or policies
- Safety concerns
- Any reason at our discretion
Upon termination by us:
- Unused hours are forfeited
- No refunds issued
- Outstanding balances remain due
Disputes
Billing Disputes
If you believe there is a billing error:
- Contact [email protected] within 30 days
- Provide detailed explanation and documentation
- We will review within 10 business days
- Our decision is final
Chargebacks
DO NOT initiate a chargeback without first contacting us.
If you initiate a chargeback:
- Your account will be immediately suspended
- We will dispute the chargeback with documentation
- You may be responsible for chargeback fees
- Account may be permanently terminated
- Outstanding balances may be sent to collections
- Fraudulent chargebacks will be reported
Acknowledgment
By purchasing any service from Kids on the Yard, you acknowledge that you have read, understood, and agree to this Refund and Cancellation Policy, including:
- All sales are final and non-refundable
- Unused hours must be used within the validity period or are forfeited
- Session cancellations with less than 24 hours notice result in charged sessions (Friday 5:00 PM Eastern Time cutoff for weekend sessions)
- Subscription cancellations require 30 days written notice with billing continuing during the notice period
- Pausing a subscription does not eliminate the 30-day cancellation billing obligation
- Calendar slot reservations are held for a maximum of 14 days during a pause
- Add-on services are billed separately and require explicit opt-in
- You are responsible for scheduling and using your purchased hours
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our liability is limited to the amount you paid for the specific session in dispute
- We are NOT liable for indirect, consequential, or incidental damages
- We are NOT liable for lost educational opportunities
- We are NOT liable for your failure to use purchased services
Legal Compliance
This policy is designed to comply with applicable consumer protection laws. Where any provision conflicts with mandatory legal requirements in your jurisdiction, the legal requirement will apply to the minimum extent necessary, and all other provisions remain in full effect.
