When engaging with any Kids on the Yard service, users agree to:

Follow scheduling commitments and provide adequate notice for changes
Respect intellectual property rights of educational materials
Report any concerns or issues promptly to our support team
Comply with all applicable terms specific to the chosen service type

Payment and Billing Policies

All services are subject to:

Clear pricing structures provided before service commencement
Flexible payment options including package deals and individual sessions
Cancellation and refund policies specific to service type
Sliding scale considerations for qualifying families
Transparent billing with detailed invoices

Reduction-Then-Cancellation Protection (Top-Level Rule)

The following rule applies across all Kids on the Yard subscription services and prevails over any service-specific billing cycle computation or adjustment-processing window that would otherwise conflict with it:

A request to reduce, downgrade, pause, or modify subscription hours does NOT reset, restart, extend, or shift the 30-day cancellation notice window. The 30-day cancellation notice runs from the date Kids on the Yard receives a written cancellation request, regardless of any prior plan reduction, downgrade, pause, or modification. In no event will a Subscriber be charged for a billing cycle that begins after a written cancellation request has been received, regardless of whether a service modification was made in the interim.

Kids on the Yard prioritizes student privacy and data security:

Compliance with COPPA (15 U.S.C. 6501-6506) for users under 13, and with FERPA only where Kids on the Yard is acting as a school official under a signed school district contract

By using our Services, you acknowledge and agree that Kids on the Yard uses IP-based geolocation technology to:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KIDS ON THE YARD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH EDUCATIONAL SERVICES, PLATFORM USAGE, OR SERVICE DELIVERY, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

Governing Law

These Terms of Service and any disputes arising from service-related matters shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the federal or state courts located in Miami-Dade County, Florida.

Personal data processed by Kids on the Yard is stored and processed in the United States under United States and Florida law, regardless of the user's country of residence.
