Overview

Thank you for considering "Kids on the Yard" Tutoring and Kids Life Coaching, operated and maintained, as applicable, by Limitless Virtue LLC, a Florida limited liability company doing business as "Kids on the Yard".

Throughout this Agreement, we may use certain words or phrases, and it is important that you understand the meaning of each. The list is not all-encompassing, and no definition should be considered binding to the point that it renders this Agreement nonsensical:

Important: Any version other than English is provided for convenience and You understand and agree that the English language will control if there is any conflict.

Type of Services

Online Education Services: A course, class or One-on-one format where students and instructors correspond and interact using virtual methods such as: email, Web conferencing, and learning management systems.

Kids on the Yard offered 6 types of Online Education Services:

Tutoring One-on-One - Live educator. One-to-one instruction describes a student learning from and interacting with a teacher individually, with instruction tailored to the student's own personal pace and learning needs.
Homeschool One-on-One - Live educator. One-to-one instruction describes a student learning from and interacting with a teacher individually, with instruction tailored to the student's own personal pace and learning needs following state guidelines and requirements.
Class / Event Study - Live educator, instruction describes a student learning from and interacting with a teacher in a group setting.
Small Group Study - 4 to 6 students in a group setting study.
E-Learning or Pre-Recorded Class - Study using Learning Management System LMS. LMS is a software application for the administration, documentation, tracking, reporting, automation, and delivery of Pre-Recorded Educational Courses, training programs, materials or learning and development programs.
Global Educational Market-Place - Where the student and the Educator are interacting direct using the platform.

While using the Global Educational Market-Place, Kids on the Yard, educational team are not responsible or involved at any stage with the process of selecting the educator.

Technology platforms are regularly updated and monitored for optimal performance
Student progress is tracked and reported to parents/guardians as appropriate
Regular quality assurance reviews ensure consistent service delivery
Technical support is available during scheduled service hours

User Responsibilities

When using our online services, users agree to:

Maintain respectful and professional communication during all sessions
Provide accurate information about educational needs and goals
Ensure reliable internet connection and appropriate technology setup
Follow scheduling commitments and provide adequate notice for any changes
Respect intellectual property rights of educational materials and content
Report any technical issues or service concerns promptly

Technology Requirements

To access our online services, users must have:

Stable high-speed internet connection
Compatible device (computer, tablet, or smartphone)
Current web browser with video/audio capabilities
Quiet, well-lit study environment for optimal learning experience
Basic computer skills appropriate for the chosen service level

Data Privacy and Security

All online services comply with applicable privacy laws and regulations:

Student data is protected through secure, encrypted platforms
All live tutoring, homeschool, class, and coaching sessions are recorded as described in the Privacy Policy. Recording consent is obtained in accordance with applicable state wiretap and eavesdropping laws, including two-party consent in California, Florida, and Montana. Personal information is shared only with Kids on the Yard service providers under written data protection agreements, only for the purposes described in the Privacy Policy, and only as permitted by applicable law
Users have rights regarding their data as outlined in our Privacy Policy

Kids on the Yard may use AI and automated technologies to enhance our online educational services:

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KIDS ON THE YARD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH ONLINE EDUCATIONAL SERVICES, TECHNOLOGY PLATFORM USAGE, OR VIRTUAL LEARNING ACTIVITIES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

Governing Law

These online service terms and any disputes arising from online service-related matters shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the federal or state courts located in Miami-Dade County, Florida.

Service Availability

Kids on the Yard offers online services worldwide (including to residents of the United States and internationally) and in-person services nationwide across the United States only. In-person availability at any specific address is determined at the ZIP-code level based on current staff capacity and scheduling, which changes frequently; contact [email protected] to confirm. Personal data processed by Kids on the Yard is stored and processed in the United States under United States and Florida law, regardless of the user's country of residence. International users should review the Privacy Statement for information about data transfers, applicable rights (including GDPR rights where applicable), and the frameworks under which personal data is processed.
