In-Person Tutoring One-on-One Terms of Service USA
Thank you for considering "Kids on the Yard" Tutoring and Kids Life Coaching, operated and maintained, as applicable, by Limitless Virtue LLC, a Florida limited liability company doing business as "Kids on the Yard".
These Terms of Service constitute a legally binding agreement (the "Agreement") between you and Limitless Virtue LLC, doing business as ("DBA") Kids on the Yard. ("Company") governing your use of the Company's applications, website, and technology Platform (collectively, the "Platform").
PLEASE BE ADVISED: IF YOU PROVIDE YOUR EXPRESS WRITTEN CONSENT (DEFINED BELOW) TO THIS AGREEMENT, YOU WILL BE SUBJECT TO PROVISIONS THAT GOVERN HOW CLAIMS THAT YOU AND COMPANY MAY HAVE AGAINST EACH OTHER CAN BE BROUGHT (SEE 'DISPUTE RESOLUTION AND ARBITRATION' IN SECTION BELOW). THESE PROVISIONS WILL, WITH LIMITED EXCEPTION, REQUIRE YOU TO SUBMIT CLAIMS YOU HAVE AGAINST COMPANY TO BINDING AND FINAL ARBITRATION ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, GROUP, OR REPRESENTATIVE ACTION OR PROCEEDING. YOU HAVE AN OPPORTUNITY TO OPT OUT OF ARBITRATION WITH RESPECT TO CERTAIN CLAIMS AS PROVIDED BELOW.

Overview
Throughout this Agreement, we may use certain words or phrases, and it is important that you understand the meaning of each. The list is not all-encompassing, and no definition should be considered binding to the point that it renders this Agreement nonsensical:
Type of Service
In-Person Education Services, a course, class, or One-on-one format where students and instructors meet in person at a Company-approved location (the student's home with a parent or guardian present, the student's school, a Kids on the Yard facility, or a public space) for educational instruction. In-Person Education Services are subject to additional safety, supervision, and conduct rules set forth in this Agreement.
Tutoring One-on-One with a Live Educator. One-to-one instruction describes a student learning from and interacting with a teacher individually, with instruction tailored to the student's own personal pace and learning needs.
Terms

"Agreement"refers to these Terms of Service and Website use. All services that we provide or that are offered through the "Website" or "this Website", including Software as a Service, and In-Person, are referred to herein as "Services". -
"Site"refers to our website, https://kidsontheyard.com, and its affiliate's domains. -
"KidsOnTheYard"or "Kids on the Yard" or"KOTY"or "Our Company" or 'Company' or"LimitlessV", refers to our company, known as Limitless Virtue LLC DBA "Kids on the Yard; our Site; our Service; or a combination of all or some of the preceding definitions, depending on the context in which the word is used.
The remainder of this Agreement is governed by the Kids on the Yard general terms (privacy policy, zero tolerance, registration obligations, consent to communications, dispute resolution, fees) cross-referenced from the top-level Terms of Service. Where the in-person nature of these services creates additional obligations (no transportation of students, two-adult rule, parent-present-in-home, mandated reporter, background screening), those obligations are stated in the In-Person Safety and Conduct section below.
Privacy Policy
We take your privacy seriously. We know you trust us to help with your children(s), Kid(s), and homework, and we want you to know that you can trust us with your personal information.

In-Person Safety and Child Protection
Kids on the Yard maintains strict in-person service rules to protect students, families, and educators. These rules apply to all in-person services without exception.
No Transportation of Students
Kids on the Yard educators NEVER transport students by any means, including private vehicle, public transit, walking, or any other method. This rule applies in all circumstances, including:
- Walking a student home from school
- Walking a student to or from a session location
- Driving a student between locations
- Accompanying a student in any form of transportation
In a medical emergency, Kids on the Yard educators call 911 and remain with the student until emergency services or a parent/guardian arrives. Educators do not transport students even in emergency situations.
Two-Adult Rule
In-person sessions are not conducted in true one-on-one isolation. A second responsible adult (a parent, legal guardian, school staff member, Kids on the Yard staff member, or other approved adult) must be present in the home, school, facility, or public space where the session occurs. The two-adult rule protects both students and educators from misunderstanding and risk.
Parent or Guardian Present in Home
For in-person sessions delivered in the student's home, a parent or legal guardian (or another responsible adult designated in writing by the parent) must be present in the home and reachable for the entire duration of the session. Kids on the Yard educators are instructed to end the session and notify the Care Team if no parent or designated adult is present.
Background Screening (Checkr)
All Kids on the Yard educators who provide in-person services undergo background screening through Checkr, a professional third-party background screening provider, including:
- National and state criminal background checks
- Sex offender registry checks
- Continuous monitoring with periodic re-verification
- A tiered disqualification framework with a child-safety overlay
For California in-home services, Kids on the Yard educators must be enrolled in the California TrustLine Registry (operated by the California Department of Social Services) before the educator may provide services in a client's home. For school-contracted services in California and other jurisdictions that require fingerprinting, Live Scan fingerprinting is performed per the contracting school district's requirements at no cost to the educator.
Mandated Reporters
All Kids on the Yard educators who work with minors are mandated reporters of suspected child abuse or neglect under the laws of the states where Kids on the Yard operates:

When a Kids on the Yard educator has reasonable cause to suspect that a child has been abused or neglected, the educator is legally required to report the suspicion to the appropriate state child welfare agency or law enforcement, regardless of any general confidentiality obligation owed to the family.
30-Day Cancellation with Reduction-Then-Cancellation Protection
Subscription cancellations require a minimum of 30 days written notice. A request to reduce, downgrade, pause, or modify service hours does NOT reset, restart, or shift the 30-day cancellation notice window. The 30-day notice runs from the date Kids on the Yard receives the written cancellation request, regardless of any prior plan modification. In-Person Service Area (United States Only)
Kids on the Yard provides in-person services nationwide across the United States only. Availability at any specific address is determined at the ZIP-code level based on current staff capacity and scheduling, which changes frequently; contact [email protected] to confirm whether a particular in-person service is available at your location. Kids on the Yard does not offer in-person services outside the United States; international customers may access Kids on the Yard online services, which are available worldwide.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KIDS ON THE YARD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH IN-PERSON TUTORING SERVICES, LOCATION-BASED TUTORING, ONE-ON-ONE INSTRUCTION, EDUCATIONAL PROGRESS, OR TUTORING EFFECTIVENESS, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
Governing Law
These in-person tutoring terms and any disputes arising from tutoring service matters shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these tutoring terms shall be brought exclusively in the federal or state courts located in Miami-Dade County, Florida.
