Oregon Consumer Privacy Act (OCPA)

Overview

The Oregon Consumer Privacy Act (OCPA) provides Oregon residents with comprehensive privacy rights regarding their personal data. Kids on the Yard is committed to complying with the OCPA and protecting the privacy of Oregon residents.


Applicability to Kids on the Yard

Kids on the Yard is operated by Limitless Virtue LLC, a Florida limited liability company headquartered in Miami Shores, Florida. Based on the applicability criteria of the Oregon Consumer Privacy Act (OCPA) described above, Kids on the Yard does not currently meet the criteria for direct application of this law, as the law's consumer-volume and data-sale thresholds are not currently met.

Although Kids on the Yard is not directly subject to the Oregon Consumer Privacy Act (OCPA) as a matter of statutory obligation, we have voluntarily adopted the rights, disclosures, and practices described on this page as a matter of best practice and out of respect for the privacy expectations of our families. The rights described above are honored by Kids on the Yard regardless of statutory applicability, through the contact procedures listed below.

If Kids on the Yard's circumstances change such that the Oregon Consumer Privacy Act (OCPA) does directly apply, the obligations described here will become legally binding rather than voluntary, and this section will be updated accordingly. Nothing in this voluntary framework limits or waives any rights you may have under the Oregon Consumer Privacy Act (OCPA) in the event the law does directly apply to Kids on the Yard.

Your Rights Under the OCPA

As an Oregon resident, you have the following rights:

1. Right to Know

You have the right to confirm whether we are processing your personal data and to access that data.

2. Right to Correction

You have the right to correct inaccuracies in your personal data.

3. Right to Deletion

You have the right to delete personal data you have provided or that we have obtained about you.

4. Right to Data Portability

You have the right to obtain a copy of your personal data in a portable, readily usable format that allows transmission to another controller.

5. Right to Opt-Out

You have the right to opt out of:

  • Sale of personal data
  • Targeted advertising
  • Profiling in furtherance of decisions that produce legal or similarly significant effects

6. Right to List of Third Parties

You have the right to obtain a list of third parties to whom we have disclosed your personal data.

Verification Process

  • We may extend this by an additional 45 days if reasonably necessary, with notice

2026 Amendments (Effective January 1, 2026)

Oregon has enacted important amendments to the OCPA effective January 1, 2026. Kids on the Yard fully complies with these enhanced requirements.

Prohibition on Sale of Minor Data

Under-16 Data Sale Ban:

  • Controllers may NOT sell personal data of consumers known to be under 16
  • Controllers may NOT sell data of consumers whose age they willfully disregard
  • This is a complete prohibition, not an opt-out right

Prohibition on Targeted Advertising to Minors

  • No targeted advertising using data from consumers under 16
  • No processing of minor data for advertising purposes
  • Enhanced protections for student data

Precise Geolocation Restrictions

New Geolocation Protections:

  • Prohibition on sale of precise geolocation data (within 1,750 feet)
  • Enhanced consent requirements for geolocation collection
  • Kids on the Yard does NOT sell geolocation data

Our Compliance

Kids on the Yard has implemented:

  • Complete ban on sale of any Oregon minor's data
  • No targeted advertising to users under 16
  • No sale of precise geolocation data
  • Enhanced age verification where appropriate
